1. Introduction

This Privacy Policy explains how NOVATRADE SOLUTIONS Sp. z o.o. (“NOVATRADE”, “we”, “us”, or “our”) processes personal data when individuals:

  • request information or a product demonstration;
  • submit a business or sales inquiry;
  • complete a product or qualification form;
  • enter into or administer a commercial relationship with us;
  • use a NOVATRADE account;
  • communicate with our team;

  • otherwise provide personal data directly to NOVATRADE.

NOVATRADE respects the privacy of individuals whose personal data we process and seeks to process personal data lawfully, fairly, transparently, and only for legitimate purposes.

This Policy primarily describes processing for which NOVATRADE determines the purposes and means of processing and therefore acts as a data controller.

Where NOVATRADE processes personal data contained in a customer’s NOVATRADE environment on behalf of that customer, NOVATRADE may instead act as a processor or service provider. That processing is addressed separately in Section 20 and, where applicable, in a Data Processing Agreement.

Where applicable, NOVATRADE processes such information subject to the same data-protection principles described in this Policy.

The exact providers may change over time as NOVATRADE’s infrastructure and business requirements develop.

Where applicable law or a customer agreement requires specific information concerning processors or subprocessors, NOVATRADE will provide that information through the appropriate contractual or customer-information process.

This Privacy Policy does not itself constitute a complete contractual subprocessor list.

18. International Data Transfers

NOVATRADE is established in Poland and operates in an international technology environment.

Some service providers, infrastructure, support functions, or recipients may process personal data outside Poland or outside the European Economic Area (“EEA”).

Where personal data subject to GDPR transfer restrictions is transferred to a country outside the EEA, NOVATRADE will use a transfer mechanism or legal basis appropriate to the relevant transfer where required.

  • the duration of a contract;

  • tax and accounting requirements;
  • applicable limitation periods;

  • whether a dispute exists;
  • whether consent has been withdrawn;
  • whether an objection has been made.

For example:

  • inquiry information may be retained while the business request or potential relationship remains relevant;
  • customer and contractual records may be retained during the commercial relationship and afterward where required for legal, accounting, tax, or claims purposes;
  • billing records may be retained according to applicable financial and tax obligations;
  • security logs may be retained for a period appropriate to security, investigation, and operational requirements;
  • marketing information may be retained until the relevant permission ends or the individual validly objects, subject to retaining limited evidence necessary to respect that choice;
  • Customer Data processed on behalf of a customer is handled according to the applicable customer agreement, Data Processing Agreement, and deletion or return procedures.

When personal data is no longer required, NOVATRADE may delete, anonymize, or otherwise securely dispose of it as appropriate.

20. Customer Data and NOVATRADE as a Processor

The NOVATRADE platform enables business customers to process information relating to their own:

  • customers;
  • prospective customers;
  • employees;
  • contractors;
  • suppliers;
  • users;
  • other individuals.

For such Customer Data, the NOVATRADE customer generally determines:

  • why the information is processed;
  • what information is entered;
  • who may access it;
  • how the customer uses the information.

In those circumstances, the customer may act as the controller and NOVATRADE may act as a processor or service provider on the customer’s behalf.

The exact legal roles depend on:

  • the specific processing activity;
  • applicable law;
  • contractual arrangements.

Where required, processing on behalf of a customer is governed by a Data Processing Agreement or equivalent contractual terms.

If an individual wishes to exercise privacy rights concerning personal data entered into NOVATRADE by a NOVATRADE customer, the individual should normally contact that customer organization first.

Where legally and contractually appropriate, NOVATRADE will assist customers in responding to data-subject requests.

21. Data Processing Agreement

Where required by applicable data-protection law or agreed with a customer, NOVATRADE may enter into a Data Processing Agreement addressing matters such as:

  • subject matter and duration of processing;
  • nature and purpose of processing;
  • categories of personal data;
  • categories of data subjects;
  • documented customer instructions;
  • confidentiality;

  • subprocessors;
  • assistance with data-subject rights;

The Data Processing Agreement governs processor activities within its scope.

This Privacy Policy is not itself a substitute for a binding Data Processing Agreement where one is required.

22. AI-Assisted Functionality

NOVATRADE services may include AI-assisted functionality.

Depending on the configured feature, AI functionality may process information to assist with tasks such as:

  • summarization;

  • operational analysis;
  • workflow recommendations.

The privacy and data-processing characteristics of an AI feature depend on:

  • the feature;
  • configured provider;
  • customer configuration;
  • applicable contract;
  • applicable Data Processing Agreement.

Where NOVATRADE processes Customer Data through an AI-related service on behalf of a customer, the processing should remain subject to the applicable customer instructions and contractual data-protection framework.

NOVATRADE does not state in this Privacy Policy that every AI provider has identical retention, location, or model-training practices.

Those matters should be assessed according to the services actually configured and the applicable contractual terms.

23. Special Categories of Personal Data

NOVATRADE’s standard website, sales, billing, and business-contact processes are not intended to require special categories of personal data such as information concerning:

Depending on the relevant system and configuration, such measures may include controls relating to:

No information system can be guaranteed to be completely secure.

NOVATRADE therefore does not make an absolute guarantee that unauthorized access, loss, misuse, or another security event can never occur.

Customers and users also have responsibilities for protecting:

  • access permissions;

25. Personal Data Breaches

NOVATRADE maintains processes for evaluating and responding to suspected personal-data incidents.

Where NOVATRADE acts as a controller and applicable law requires notification of a personal-data breach, NOVATRADE will make the required notification to the competent supervisory authority and, where required, affected individuals.

Where NOVATRADE acts as a processor, incident-notification obligations are governed by applicable law and the relevant Data Processing Agreement or customer agreement.

This Policy does not create a fixed notification deadline beyond the deadline required by applicable law or a binding customer agreement.

26. Your Data Protection Rights

Depending on applicable law and the circumstances of the processing, individuals may have rights including:

Right of Access

The right to obtain information about whether NOVATRADE processes personal data concerning you and, where applicable, access to that data.

Right to Rectification

The right to request correction of inaccurate personal data and completion of incomplete data where appropriate.

Right to Erasure

The right to request deletion of personal data in circumstances provided by applicable law.

This right is not absolute and may not apply where continued processing is legally justified.

Right to Restriction

The right to request restriction of processing in circumstances provided by applicable law.

Right to Data Portability

Where the applicable legal requirements are met, the right to receive certain personal data in a structured, commonly used, machine-readable format and to transmit it to another controller.

Right to Object

Where processing is based on legitimate interests, you may have the right to object based on your particular situation.

Right to Object to Direct Marketing

Right to Withdraw Consent

Where processing is based on consent, you may withdraw that consent at any time.

NOVATRADE will not request more personal data than reasonably necessary to verify and process the request.

Where a request relates to Customer Data processed by NOVATRADE on behalf of a customer, NOVATRADE may direct the individual to the relevant customer controller or coordinate with that customer as appropriate.

NOVATRADE will respond within the timeframe required by applicable data-protection law.

28. Right to Lodge a Complaint

Individuals whose personal data is subject to the GDPR have the right to lodge a complaint with a competent supervisory authority.

In Poland, the supervisory authority is:

President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, UODO)

Information about UODO and complaint procedures is available at: https://uodo.gov.pl

Where another supervisory authority is competent under applicable data-protection law, an individual may also have the right to approach that authority.

NOVATRADE encourages individuals to contact us first where appropriate so that we have an opportunity to investigate and respond to the concern, but contacting NOVATRADE is not intended to remove a statutory right to lodge a complaint.

29. Automated Decision-Making

NOVATRADE may use automation to support:

  • security;
  • fraud prevention;
  • service administration;
  • operational workflows;
  • AI-assisted functionality.

NOVATRADE does not rely on this Privacy Policy as notice of any undisclosed solely automated decision that produces legal effects or similarly significant effects on an individual.

If NOVATRADE introduces processing requiring specific information concerning automated decision-making under applicable law, the relevant information will be provided as required.

AI-generated recommendations or workflow assistance do not remove the responsibility of authorized users to review important decisions.

30. Children

NOVATRADE provides business software intended for professional and organizational use.

Our website and services are not directed to children.

We do not intentionally request children to create ordinary NOVATRADE business accounts or submit business inquiries.

If we become aware that personal data has been provided by a child in circumstances where the processing is not appropriate or lawful, we will take reasonable steps to address the matter.

The NOVATRADE website or platform may contain links to or integrations with third-party services.
